1. Acceptance of Terms

Welcome to DoctorAdam. These Terms of Use ("Terms") govern your access to and use of the DoctorAdam website, telehealth platform, mobile applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years of age and reside in a state where our providers are licensed in order to use the Services. By using the Services, you represent that all information you provide is accurate and complete.

3. Medical Services Disclaimer

DoctorAdam is a telehealth platform that connects patients with independent, licensed healthcare providers. DoctorAdam does not practice medicine and does not replace your primary care provider.

All medical decisions are made solely by licensed providers based on clinical judgment and applicable law. No guarantee of treatment outcomes is made.

Emergency Notice: DoctorAdam is not appropriate for medical emergencies. If you are experiencing a medical emergency, call 911 immediately.

4. Membership & Program Participation

4.1 Enrollment

Membership begins once a licensed provider reviews your information and you accept the proposed treatment plan. Acceptance of treatment acknowledges understanding of risks and benefits.

4.2 Included Services

  • 12-month membership
  • Up to eight (8) medical consultations per year
  • Up to eight (8) lab panels per year (lab costs not included)
  • Up to eight (8) at-home blood draws
  • Secure provider messaging
  • Prescription fulfillment, if medically appropriate

4.3 Additional Service Fees

  • $15 per additional consultation or lab interpretation
  • $125 per additional at-home blood draw

Additional fees will be charged within seven (7) days of service.

4.4 Payment Terms

Membership fees are billed automatically on a recurring monthly basis until canceled. Initial fees are non-refundable unless otherwise required by law.

5. Prescription Policy

Prescription medications are provided only if deemed medically appropriate by a licensed healthcare provider. Not all patients will qualify for treatment.

Once a prescription has been processed and shipped by the dispensing pharmacy, it cannot be canceled or returned due to federal and state regulations governing prescription medications.

6. Laboratory & Phlebotomy Services

6.1 Laboratory Testing

DoctorAdam may coordinate laboratory testing through third-party providers. Laboratory costs are not included in Membership fees unless explicitly stated.

6.2 At-Home Phlebotomy

At-home blood draw services are provided by third-party partners. DoctorAdam is not responsible for delays or performance of independent laboratory providers.

7. Telemedicine Consent

You understand that telemedicine involves electronic communication and may include asynchronous communication (store-and-forward technology). Potential risks include:

  • Technical failures
  • Privacy breaches
  • Incomplete medical information
  • Delays in diagnosis or treatment

You acknowledge and accept these risks by using the Services.

8. No Testosterone Replacement Therapy

DoctorAdam does not provide testosterone replacement therapy (TRT), including injections, gels, patches, or pellets.

9. Cancellations & Pauses

9.1 Delay or Pause

You may delay or pause your Membership through your account settings. Treatment interruption may require re-evaluation by a provider.

9.2 Cancellation

You may cancel at any time. Fees already paid are non-refundable unless required by law.

10. Intellectual Property

All content on the Services, including text, graphics, logos, and software, is the property of DoctorAdam and protected by intellectual property laws.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Governing Law and Dispute Resolution

1. Governing Law

These Terms and any dispute arising from your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

2. Binding Arbitration Agreement

By using the Services, you agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, telehealth consultations, prescriptions, billing, or your relationship with DoctorAdam shall be resolved exclusively through final and binding arbitration.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration will take place in New York, New York, unless otherwise required by law. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, enforceability, or formation of this arbitration agreement.

3. Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as part of a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit, class arbitration, or representative proceeding against DoctorAdam.

4. Waiver of Jury Trial

To the fullest extent permitted by law, you waive any right to a trial by jury in any dispute arising out of or relating to the Services.

5. Exceptions

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property rights, confidential information, or regulatory compliance.

13. Privacy

Your use of the Services is also governed by our Privacy Policy and HIPAA Notice of Privacy Practices.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.
